According to heise/dpa, minister Bilger said on 6 Oct 2026 that if no agreement is reached at EU level, one would have to talk about “what could be done in Germany” – legally a national recognition under Art. 39(5) Reg. (EU) 2018/858. According to heise, the KBA also wants to test a vehicle itself.

Tesla Assisted Driving is currently approved nationally in 8 of 27 EU countries, covering about 12.7 % of the EU population. EU-wide approval requires a qualified majority in the Technical Committee on Motor Vehicles (TCMV): at least 15 of the 27 countries, together representing at least 65 % of the EU population. Germany accounts for 18.6 % of the EU population.

What is the difference between FSD and TAD?

None in terms of function: on 9 October 2026 Tesla renamed “Full Self-Driving (Supervised)” to “Tesla Assisted Driving” in Europe. It remains an SAE Level 2 assistance system. More about the renaming.

How can TAD be approved in Germany?

In two ways: Germany can recognise the provisional Dutch approval nationally (Art. 39(5) Reg. (EU) 2018/858), or the EU agrees to an EU-wide approval. EU-wide approval requires a qualified majority in the Technical Committee on Motor Vehicles (TCMV): at least 15 of the 27 countries, together representing at least 65 % of the EU population.
